RECRUITMENT PRIVACY NOTICE

1. INTRODUCTION

Dateio s.r.o., Beníškové 1285, 150 00 Prague 5, Czech Republic, Company ID: 02216973 (“Dateio”, “we”, “us”or “our”), respects the privacy of job applicants and takes the security of their personal information seriously.

This Recruitment Privacy Notice explains how we collect and process personal information relating to individuals who apply for employment or another form of cooperation with Dateio, or who are referred to us in connection with a potential job opportunity.

This Notice applies regardless of how we receive your application or information about you.

2. HOW DO WE OBTAIN YOUR PERSONAL INFORMATION?

You may apply directly through the Dateio website, by contacting us at job@dateio.eu, or through third-party recruitment and job advertising platforms.

Depending on the particular vacancy, we may receive applications through several platforms and local or international recruitment and job advertising websites that we may use from time to time.

We may also receive information about you through a referral from one of our employees, contractors or other business contacts. Before we contact you, such a referral may include your name, contact details and basic information about your professional background or experience.

Where we receive personal information about you from a third party, we process only information relevant to the potential job opportunity and recruitment process.

3. WHAT PERSONAL INFORMATION DO WE PROCESS?

Depending on the position and the recruitment process, we may process identification and contact information, information contained in your CV and other documents you provide, and information concerning your education, qualifications, professional and language skills, employment history and previous professional experience.

We may also process information about the position for which you have applied, your availability and employment expectations, interview notes and assessments created during the recruitment process, communications between you and Dateio and any other information you choose to provide during the recruitment process.

We seek to collect only information that is relevant and necessary to assess your suitability for the relevant position.

We generally do not request special categories of personal data, such as information concerning health, political opinions, religious or philosophical beliefs or sexual orientation, unless such information is necessary in the particular circumstances and its processing is permitted under applicable law.

We will only request or process information relating to criminal convictions or offences where this is required or permitted by applicable law or objectively justified by the nature of the particular position.

4. WHY DO WE PROCESS YOUR PERSONAL INFORMATION?

Assessing your application and conducting the recruitment process

We use your personal information to receive and assess your application, evaluate your professional experience and qualifications, arrange and conduct interviews, communicate with you and determine whether to offer you employment or another contractual relationship.

The legal basis for this processing is primarily Article 6(1)(b) GDPR, as the processing is necessary to take steps at your request prior to entering into a contract.

Managing the recruitment process

We may also process certain personal information in order to administer and coordinate our recruitment processes, maintain appropriate recruitment records and protect our systems and legal interests.

Where appropriate, we rely onour legitimate interests under Article 6(1)(f) GDPR, in particular our interests in efficiently managing recruitment processes, protecting our rights and maintaining the security of our systems.

Candidate referrals

Where one of our employees or another person provides us with limited professional or contact information about you, we may initially process this information in order to assess whether a particular employment opportunity may be relevant to you and to contact you.

The legal basis for this initial processing is our legitimate interest under Article 6(1)(f) GDPR in identifying suitable candidates.

If you subsequently decide to participate in a particular recruitment process, the further processing of your information will generally be necessary to take steps at your request prior to entering into a contract.

Compliance with legal obligations

In certain circumstances, we may process personal information where this is necessary to comply withobligations arising under applicable employment, tax, immigration or other laws.

The legal basis for such processing is Article 6(1)(c) GDPR – compliance with a legal obligation.

Future job opportunities

If you are not selected for the position for which you have applied, we may offer you the opportunity to allow us to retain your information and contact you about suitable positions in the future.

Such further processing will be based on your consent under Article 6(1)(a) GDPR. You may withdraw your consent at any time.

5. RECRUITMENT PLATFORMS AND OTHER THIRD PARTIES

We use various external job advertising websites, recruitment platforms and other service providers in connection with our recruitment activities.

Depending on the particular service and processing activity, these providers may process personal information on behalf of Dateio as our processors or may process certain personal information for their own independently determined purposes as separate controllers.

Where you maintain an account with or otherwise use a third-party recruitment platform, the platform may therefore also process your personal information in accordance with its own terms and privacy notice.

Where a service provider processes personal information on behalf of Dateio, we require appropriate contractual and security safeguards in accordance with applicable data protection law.

6. WHO MAY WE SHARE YOUR PERSONAL INFORMATION WITH?

Access to your personal information is limited to individuals who need it for the relevant recruitment process, including employees responsible for recruitment or HR activities, relevant hiring managers and other employees involved in assessing candidates for the particular position.

Where necessary, information may also be shared with other Dateio group companies or affiliates, for example where they participate in the recruitment process or where the relevant position relates to such an entity.

Personal information may also be processed by recruitment and HR service providers, job advertising platforms, IT, cloud and communications providers and our professional advisers.

We may also disclose personal information to public authorities or other parties where required by applicable law.

Where a third party processes personal information on our behalf, we require appropriate confidentiality, security and data protection safeguards.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

We retain personal information relating to a particular recruitment process only for as long as necessary to conduct and complete the recruitment process and for a limited period afterwards where necessary to address questions or potential legal claims arising from the recruitment process.

As a general retention standard, we recommend that Dateio retain the complete application file of an unsuccessful candidate for no longer than six months following completion of the relevant recruitment process.

Where it is reasonably necessary to retain a limited recruitment record for the establishment, exercise or defence of legal claims, such information may be retained for alonger period corresponding to the applicable limitation period.

Where you have consented to us retaining your information for future employment opportunities, we may retain it for up to two years from the date of your consent, unless you withdraw your consent earlier.

If you become an employee or contractor of Dateio, relevant information collected during the recruitment process may become part of your personnel or contractual records and will subsequently be processed in accordance with the privacy information applicable to employees or contractors.

8. INTERNATIONAL TRANSFERS

As we may occasionally use international recruitment platforms and technology providers, personal information may in certain circumstances be processed outside the European Economic Area (“EEA”).

Where Dateio transfers personal information to a country that has not been recognised by the European Commission as providing an adequate level of protection, we implement appropriate safeguards as required by applicable data protection law. These may include the European Commission’s Standard Contractual Clauses and,where appropriate, supplementary safeguards.

Where a third-party recruitment platform processes your information for its own purposes as an independent controller, its own privacy notice applies to any international transfers carried out by that provider.

9. SECURITY

We implement appropriate technical and organisational measures designed to protect your personal information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

Access to recruitment information is restricted to individuals who require such access for their role or for the relevant recruitment process.

10. AUTOMATED DECISION-MAKING

Keep this section only if confirmed by HR:

Dateio does not make recruitment decisions based solely on automated processing of personal data, including profiling, which produce legal effects concerning applicants or similarly significantly affect them.

11. YOUR RIGHTS

Subject to the conditions setout in applicable data protection law, you have the right to request access to your personal information, request correction of inaccurate information, request erasure or restriction of processing and, where applicable, receive certain information in a portable format.

Where processing is based on our legitimate interests, you have the right to object to such processing.

Where processing is based on your consent, you may withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before your consent was withdrawn.

You also have the right to lodge a complaint with a competent data protection supervisory authority.
